If we are going to have an honest debate we first must agree to a few fundamental facts. Most corporations are closely held corporations and ninety-five percent are family owned, and provide employment for approximately fifty percent of the nation&#039;s population. We must first agree that being a corporation is by itself NOT a bad thing and certainly corporations are income generators that provide employment, tax revenues, and a tax base.
As far as the constitutionality of HB1002 lets again look at it foundationally. First the purpose of the constitution is to restrain government while allowing the maximum opportunity for freedom and liberty of its citizens. So the first question is does HB1002 restrain government and allow for freedom and liberty of its citizens? In my opinion it does both. Taxes are collected by taking the money earned by labor or investment from its citizens who traded their freedom and liberty for that money. 
You also referred to the general welfare clause in the constitution. The general welfare clause is found in only two places in the constitution. The first is in the Preamble. The Preamble has no legal authority whatsoever as far as the constitution is concerned. As a matter of fact the Preamble was written after the constitution and was written to essentially explain the purpose of the constitution generally. The second place it is found is in Article 1 section 8 which grant the government to levy taxes by default also the authority to take the taxes away so this too makes HB 1002 constitutional.
 Last but not least the words, “general welfare”. Since the writing of the constitution there have been two trains of thought as it pertains to those two words. The first argument is that spending would be limited to the constitutions enumerated powers and the second not limited at all. The point is that passing of HB1002 does not limit the Federal nor the State government to spend as it wills. So I believe the only argument left is that because HB1002 limits revenue to the government it therefore on its face would be unconstitutional. To make this argument would be then to have to make every bill that cuts taxes unconstitutional and that of course isn’t possible either.
As far as jobs and the economy is concerned there are a few immutable facts. Closely held corporations account for over 50% of the jobs in Arkansas. Capital goes to where it is welcomed and profitable. You can have Capital Gains without creating one job, but you cannot create one job without capital. There are many things wrong with the system and we can’t fix them all. One thing is for certain we have to rely on each other without stooping to emotional appeals, misunderstandings and mistruths. You cannot elevate the poor by lowering the rich. You elevate the poor by offering them the opportunity for success and helping them through the process. The old saying is still true today, “Give a man a fish he eats for a day, teach a man to fish he eats for a lifetime. Let’s teach each other how to fish.</description>
